1. Acceptance of These Terms

Welcome to the website of PMG RE Business Group (“PMG,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of pmgregroup.com, including its pages, forms, consultation scheduling features, resources, communications, and other website functionality (collectively, the “Site”).

By accessing or using the Site, submitting information through it, or scheduling a consultation, you acknowledge that you have read and understood these Terms and agree to be bound by them.

If you do not agree with these Terms, please do not use the Site.

2. About PMG RE Business Group

PMG RE Business Group provides real-estate-related property solutions and guidance, with a particular focus on homeowners, families, heirs, executors, personal representatives, and others dealing with property transitions in Naperville, the Chicagoland area, and other areas in which PMG lawfully operates.

Services presented through the Site may include:

  • Consultations regarding real estate options;
  • Assistance relating to probate or inherited properties;
  • Opportunities to sell qualifying properties in their current or “as-is” condition;

3. Website Information Is Not a Binding Transaction

Information on the Site is provided for general informational and introductory purposes.

Nothing on the Site constitutes:

  • A listing or brokerage agreement;
  • A purchase and sale agreement;
  • An agency relationship;

A real-estate transaction becomes binding only when the appropriate parties execute legally enforceable transaction documents.

If there is a conflict between these Terms and a separately signed purchase agreement, brokerage agreement, service agreement, disclosure, or other transaction document, the applicable signed transaction document will control with respect to that transaction.

4. Probate and Inherited Property Disclaimer

PMG recognizes that probate and inherited-property matters can involve sensitive family, financial, fiduciary, and legal issues.

Unless expressly provided by a separately identified and properly licensed legal professional, PMG RE Business Group is not acting as your attorney and does not provide legal, probate, estate-planning, tax, accounting, or fiduciary advice.

Information concerning probate, executors, administrators, heirs, inherited homes, estates, or similar subjects is intended to help users better understand real-estate considerations and available property options. It should not be relied upon as a substitute for advice from a qualified Illinois attorney, accountant, tax adviser, or other appropriate professional.

Probate procedures and the authority to sell estate property may vary depending on matters including the decedent’s will, type of estate administration, letters of office, ownership interests, court orders, liens, claims, and other circumstances.

You are responsible for obtaining appropriate professional advice concerning your legal authority and obligations before entering into a transaction involving estate or inherited property.

5. Authority to Discuss or Transfer Property

If you submit a property, request a consultation, negotiate a transaction, or provide information concerning real property, you represent that the information you provide is accurate to the best of your knowledge and that you either:

  1. Own or have a lawful interest in the property; or
  2. Are legally authorized to act for the owner, estate, trust, entity, or other interested party.

PMG may request reasonable documentation concerning ownership or authority before proceeding with a transaction.

Submitting information about a property does not establish your legal authority to sell or transfer that property.

6. Real Estate Brokerage and Agency Relationships

Use of the Site, communication with PMG, or participation in an initial consultation does not by itself create a broker-client, agency, fiduciary, or other professional relationship.

If PMG or an affiliated professional provides services that constitute licensed real estate brokerage under Illinois law, the applicable brokerage relationship, duties, disclosures, compensation terms, agency status, and other legally required matters will be governed by separate documentation and applicable law, including the Illinois Real Estate License Act of 2000.

Nothing in these Terms replaces any disclosure, written brokerage agreement, or other document required by applicable real-estate law.

7. “As-Is” Property Solutions

The Site may describe opportunities for homeowners or estates to sell property in its existing or “as-is” condition.

“As-is” does not mean that legal requirements, transaction disclosures, title requirements, contractual obligations, or other applicable duties cease to apply.

Any potential purchase, sale, or property solution may be subject to evaluation of matters such as:

  • Ownership and authority to sell;
  • Title;
  • Liens and encumbrances;
  • Property condition;
  • Occupancy;
  • Taxes;
  • Probate or estate requirements;
  • Inspection or due diligence;
  • Financing or closing requirements; and
  • Agreement by the relevant parties.

PMG does not guarantee that every property will qualify for a particular solution.

8. Consultations and No-Obligation Discussions

PMG may offer complimentary or no-obligation consultations.

Scheduling or participating in such a consultation does not require you to sell a property, purchase a service, or enter into a transaction unless you later voluntarily execute a separate binding agreement.

Likewise, PMG is not obligated to purchase, list, market, or otherwise become involved with a property merely because a consultation has occurred.

9. Communications

When you provide your telephone number, email address, or other contact information, PMG may use the information to respond to your inquiry, schedule or confirm a consultation, discuss a property or service you requested, and provide other communications permitted by law.

Marketing communications will be handled in accordance with applicable federal and Illinois requirements.

You may request that marketing communications stop at any time. Email marketing messages will provide an applicable unsubscribe method. Where SMS marketing is used, you may follow the opt-out instructions provided in the message, such as replying STOP, where applicable.

Requests not to receive applicable marketing calls will be honored in accordance with applicable law.

Consent to receive marketing communications is not intended to waive any rights available to you under applicable law.

10. Equal Housing Opportunity

PMG supports fair and equal treatment in real-estate transactions.

PMG does not intend to discriminate in the availability, terms, negotiation, advertising, or handling of real-estate opportunities on a basis prohibited by applicable federal, Illinois, or local fair-housing and human-rights laws.

Nothing on the Site should be interpreted as indicating a prohibited preference, limitation, or discriminatory practice.

11. Accuracy of Information

PMG attempts to provide useful and current information, but real estate, probate procedures, market conditions, laws, third-party services, property information, and other circumstances may change.

We do not warrant that every statement on the Site will always be complete, current, error-free, or applicable to every situation.

You should independently verify information that is material to a legal, financial, tax, probate, or real-estate decision.

PMG may correct, update, remove, or modify Site content without prior notice.

12. Third-Party Services and Links

The Site may use or link to third-party services such as:

13. Intellectual Property

Unless otherwise stated, the Site and its original content, including text, branding, graphics, layouts, photographs owned or licensed by PMG, logos, design elements, downloadable materials, and other content, are owned by or licensed to PMG and are protected by applicable intellectual-property laws.

You may use Site content for your personal, noncommercial evaluation of PMG’s services.

You may not reproduce, republish, modify, sell, distribute, scrape, commercially exploit, or create derivative works from protected Site content without authorization from PMG or the applicable rights holder.

14. Prohibited Uses

You may not use the Site to:

  • Violate any applicable law or regulation;

16. No Professional Advice

Website content is not intended to constitute legal, tax, accounting, financial, appraisal, engineering, inspection, or other regulated professional advice.

Real-estate and probate circumstances can vary materially from one property or estate to another.

17. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Site is provided on an “as available” and “as is” basis.

PMG does not guarantee uninterrupted access, error-free operation, a particular outcome from use of the Site, availability of a specific property solution, or successful completion of any proposed transaction.

Nothing in this provision excludes a warranty or legal obligation that cannot lawfully be excluded.

18. Limitation of Liability

To the fullest extent permitted by applicable law, PMG will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages arising solely from your use of, inability to use, or reliance on the Site.

This limitation does not apply to liability that cannot legally be limited or excluded, including where applicable liability arising from fraud, willful misconduct, or other conduct for which limitation is prohibited by law.

Separate transaction agreements may contain additional allocation-of-risk provisions applicable to a particular transaction.

19. Indemnification

To the extent permitted by law, you agree to be responsible for losses, liabilities, claims, or reasonable expenses arising from your unlawful misuse of the Site, your intentional submission of materially false information, your infringement of another person’s rights, or your purported action on behalf of a property owner or estate without lawful authority.

This section does not require you to indemnify PMG for PMG’s own unlawful conduct.

20. Governing Law and Venue

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, except where federal law or another jurisdiction’s mandatory law applies.

For disputes relating solely to use of the Site, the parties agree that any court proceeding may be brought in a state or federal court having appropriate jurisdiction in DuPage County, Illinois, unless applicable law requires a different forum.

A separate real-estate or service agreement may specify different or additional dispute-resolution provisions.

21. Changes to These Terms

PMG may update these Terms to reflect changes to its Site, services, business practices, or applicable law.

The revised version will be posted on the Site with an updated “Last Updated” date.

Material changes will apply prospectively to the extent required by applicable law and will not retroactively alter the terms of an already executed real-estate transaction except as permitted by the applicable agreement and law.

22. Severability

If a provision of these Terms is determined to be invalid or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where permitted by law. The remaining provisions will continue in effect.
